In the same way that you have to prepare for physical storms of life, such as hurricanes, high winds, and snow storms, you have to be prepared for the other storms in life. Those storms can include stroke, dementia, heart attack, mental disability, your children’s divorce, car wreck law suits, and law suits by tenants and neighbors. If you do not have proper Estate Planning when those storms come, you will have no control and the outcome may not be what you want. Those you love and who you would want to be in control, may not have the legal authority to help you.
You’ll want to make sure that you have the proper Health Care Directives in place in the event you become sick, mentally disabled, or end up on a ventilator. You’ll also want to make sure that those Health Care Directives are able to move from state to state. We are an hour and half drive from crossing into four other states. You want to make sure that they work outside of North Carolina.
In the event you don’t have a properly written Revocable Living Trust or Will, your assets will not move the way you want them to move when you pass on. As we have discussed many times, if you become mentally disabled and have proper mental disability planning inside your Living Trust. You can state your specific desires as to whether or not you want to stay home as long as possible, how you want to be cared for, and if you have to be in a care facility which one you want.
Storms of life like hurricane Sandy will come. As will storms like illness, dementia, or death. We need to be prepared for those also.
